Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the https://www.woodenroots.com website (the “Service”) operated by Wooden Roots Ltd (“us”, “we”, or “our”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

When buying goods and services on the Internet, you, the consumer are entering a legally binding contract. The following Terms and Conditions are set in accordance with UK Trading Standards, the UK law being the applicable law. Please take the time to read the following information. These Terms and Conditions apply to all on-line transactions and different policies may apply to in-store purchases.

Pricing & Payment

All prices on our website are in £ Sterling. We accept all major credit and debit cards including American Express. We will also take PayPal and pre-arranged bank transfers via BACS.

Payment Security

All payments for online orders are securely processed by World Pay payment processing system or PayPal. Customer credit card data for online transactions is not visible to any member of Wooden Roots staff. Furthermore, we do not harvest records of customer information for use by third parties. We operate an optional opt-in system for our store mailing list which you may remove yourself from at any time. When you order by telephone with your credit card, all retailer copies of credit card receipts are shredded following the sale. Card receipt copies are sent out with goods, but only display the last four card digits and expiry date. Wooden Roots endeavour to operate strictly within current PCI DSS regulations and have implemented the necessary measures required for our merchant level.

Acceptance Of Your Order

When you place an order online on the Wooden Roots website and complete the checkout process, you will automatically receive an email confirmation notifying you about your order details. However, completion of the checkout process does not constitute our acceptance of your order. Acceptance of your order takes place at the moment we dispatch the goods you have ordered from Wooden Roots.

The Service and its original content, features and functionality are and will remain the exclusive property of Wooden Roots Ltd and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Wooden Roots Ltd.

You agree to defend, indemnify and hold harmless Wooden Roots Ltd and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

Limitation Of Liability

In no event shall Wooden Roots Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

100% Satisfaction Guarantee

If you’re not completely satisfied with your purchase, you may return your item(s) (in its/their original condition) to Wooden Roots within 15 days for a full refund  (minus a 25% restocking fee – See “Wooden Roots Return Policy” below). Restocking fee does not apply to authorized exchanges with are on a discretionary basis. In order for you to receive a full refund on drums, other instruments, tools, accessories, drum building supplies, garments and skins, they must not have any visible signs of use or wear, and must not be damaged. All returns that involve natural products i.e. broken drum heads, skins, cracked wood, died fabric etc. are handled on a case by case basis, as these are materials that are subject to the elements and must be recognized as such by the buyer.  How your refund is handled is up to you, it can be a credit towards another product, or a credit refund can be issued to the original charge card/payment method.  This will be processed as quickly as possible.  Your refund does NOT include shipping back to us or back to you if another drum or item is purchased or exchanged. If you fail to contact us within 15 days of delivery you will not be eligible for the satisfaction guarantee refund.

Wooden Roots Return Policy

By purchasing from Wooden Roots you agree to the following terms;

There will be a 25% restocking fee for all returned items. Restocking fee does not apply to authorized exchanges. All purchases made from our website as well as any orders made via phone or in person are granted a fifteen (15) day approval period from the date received. If you decide not to keep the merchandise, you may ship/bring it back to our warehouse in the original packaging at your own expense. When we receive the item(s) and it’s in its original condition, we will refund the amount of the purchase, less the 25% re-stocking fee.  We WILL NOT REFUND any shipping costs incurred to get the item to us. Should you decide to choose a different item, you, the customer are responsible for all shipping fees to and from our warehouse.

Wooden Roots Return Policy for “Custom ordered/built instruments”

Instruments that are custom built and ordered to precise customer specifications will need to be handled on a case by case bases as there are many scenarios which may or may not apply.  For instance, changing your mind when the order has already begun or has been completed, and/or if you do not like the instrument after it has been built.  Depending on the scenario items may or may not be returned.  Since time and effort has already been invested in a custom ordered instrument a 50% restocking fee may be applied for all retuned / unwanted items.

Skin breakage on instruments and drums

As instruments are hand built using natural organic materials, natural breakages may occur.  This is the pure nature of these instruments especially djembes.  At some point in the life of a djembe the skin will eventually break and you will never know when.  The critical time is usually within the first few months of purchase while the skin is still settling in.  To help offset this Wooden Roots offers a one (1) time free head re-skin/breakage repair on all of our djembes should this occur within two (2) months of you purchasing & receiving the djembe.  It takes a few months for a djembe skin to properly settle in and this will give you some peace of mind as we will repair it free of charge if it breaks due to a non-negligible situation on the customers part.  All you have to do is pay to send it to us and pay to send it back and your drum will be re-headed.  This does not mean that you are openly allowed to tune your new drum to the point that it would prematurely cause the skin to break and should we receive the drum and find that you have done this you all be charged for a new re-head.  We send you your djembe at a normal playing tension so that your drum can properly acclimate to its new environment and so that you can properly distinguish it for accompaniment playing – it is specifically Not tuned HIGH-pitched for soloing. To gain the most from your djembe we recommend slowly tuning your drum over a few months so that your drum can ease and settle into itself naturally.

Skin Warranty

For individual skins bought for personal use/building and not used on any instrument that was built by Wooden Roots.

All skins are received into Wooden Roots from West Africa with a certificate of origin and have passed a veterinary inspection. We use the same skin supplier for all of our in-house repairs and builds.  All skins are naturally rendered and are not chemically treated.  We take every effort to supply skins which are free from imperfections, i.e. blemishes, scars, holes and select the best available skins that we would also use for our instruments.  However, please note that no natural skin is perfect!  Also, knowing that skins are used for purposes out of Wooden Roots’ control i.e. we don’t know what, how and where you are applying the skin we simply cannot guarantee or offer a warranty on skins due to this nature and will not be refunded if used.  **We ask that you please inspect all skins prior to use. Skins can be returned within 15 days if not soaked or used or modified.  Wooden Roots does not guarantee the life of a natural animal skin.  (A 25% restocking fee applies for all returns).
